Introduction

    • By utilizing and entering into our platform, you acknowledge your agreement to abide by the terms and conditions of website access [defined as General Terms and Conditions] and our privacy policy. Your affirmation includes having read and consenting to our General Terms and Conditions. If you disagree, you are not authorized to use our website or access our services. Please read these terms and conditions carefully before using our services.

Consultation Services:

    • DrWellbeing Inc. [referred to as “we,” “us,” or “our”] provides consultation, training, and coaching services [defined as Services] based on academic and research experience, aimed at promoting wellbeing, transitions, and personal development. It offers comprehensive wellbeing, positive school transition, and stress management workshops and programs dedicated to fostering personal development and overall wellbeing.
    • We are NOT a medical practice, and our services are not intended to diagnose, treat, or cure any medical condition. Our services are educational in nature and do not constitute medical advice.

Wellbeing Guidance and Support:

    • DrWellbeing Inc. emphasizes that it does not offer therapy or psychological services. While our team includes individuals with advanced degrees in psychology, it is important to note that we are not registered psychologists. Our services are not intended to replace professional therapy or psychological treatment. Individuals seeking therapeutic support are encouraged to consult licensed psychologists for personalized assistance.

Scope of Services and Modifications to Services

    • While we strive to provide accurate and reliable information, we make no representations or warranties regarding the completeness or reliability of the content provided or the short-term or long-term benefits of our offerings. Our services are intended for informational and empowerment purposes only. Users are encouraged to exercise their own judgment and discretion when implementing the insights gained from our offerings.
    • We reserve the right to make changes to our website and services at any time without prior notice. Such changes may include updates, modifications, or discontinuation of certain features or offerings. We shall not be liable to you or any third party for any modifications, suspension, or discontinuation of our services.

Client Responsibilities

    • Clients are responsible for evaluating the suitability and appropriateness of our services for their individual needs and circumstances. It is important to consult with qualified healthcare professionals regarding any medical concerns or conditions before making lifestyle or wellness changes.

Right to Refuse Consultation or Training

    • DrWellbeing Inc. reserves the right to refuse consultation or training services to any individual or entity for reasons including but not limited to overbooking, scheduling, conflicts, or disrespectful comments or behaviour. We prioritize maintaining a professional and respectful environment for all our clients and associates. Decisions to refuse services are made at the discretion of DrWellbeing Inc. and are final.

Refund and Cancellation Policy

By booking an appointment or registering for a workshop/program with DrWellbeing, you are agreeing to the terms outlined in our refund and cancellation policy.

Refunds

Eligibility for refunds is determined by the following criteria:

  • Cancellations made at least 24 hours before the scheduled appointment are eligible for a full refund. For workshops or program bookings, a minimum of one week’s notice is required for cancellation or rescheduling to qualify for a full refund.
  • Cancellations made less than 24 hours before the scheduled time are not eligible for refunds.
  • All refunds will be processed to the original payment method used at the time of booking.

 Service Satisfaction Clause

  • Given the specialized nature of the services offered, including expert advice, professional consultations, and specialized workshops and programs, refunds based on subjective dissatisfaction with the service are not provided. This policy is in accordance with Alberta’s Consumer Protection Act, which allows for services to be excluded from refund eligibility based on the completion of service as agreed upon in the service contract. Our commitment is to provide services of the highest standard, guided by professional expertise and evidence-based practices. However, since satisfaction can be highly subjective and influenced by factors beyond our control, it is not a condition eligible for a refund.

Cancellations and Rescheduling

  • To cancel or reschedule an appointment or workshop booking, please contact DrWellbeing directly via email or phone.
  • DrWellbeing reserves the right to cancel or reschedule appointments or workshops/programs due to unforeseen circumstances. Affected clients will be notified as soon as possible and provided with options to reschedule or receive a full refund.
  • Should DrWellbeing cancel a session, participants have the option of receiving a full refund or rescheduling for a later date.

 No-Show Policy

  • Failure to attend a scheduled session without prior notification will result in the forfeiture of the booking fee, and no refund will be issued.

Exceptions

  • DrWellbeing may, at its discretion, consider exceptions to this policy under extenuating circumstances. Such requests will be evaluated on a case-by-case basis and require sufficient documentation.

    3. Results may vary, and we do not assure any particular outcome from the information, insights, or training provided.

Minor Access Provision

If you are a student or child or under the age of majority (a minor), there are specific requirements you must follow to use our services:

Through Schools or Parents

Minors may only access our services through their affiliated school or with explicit parental consent. This access is contingent upon agreeing to our User Terms [defined as User Terms] and successfully completing the consent process designed to protect minors.

  • Parental Consent Required

If you are below the age of majority, which varies by jurisdiction but is typically 18 years of age, it is a legal requirement that you obtain consent from your parent or legal guardian before using our services. This consent must be verifiable, ensuring that your parent or guardian has knowingly agreed to allow you to access our services under the terms we provide.

  • Affirmation of Consent

By using our services, you affirm that you have received permission from your parent or legal guardian. Accessing our services without such consent is not permitted under our User Terms. We reserve the right to terminate access or take other necessary actions if it is discovered that services are being used without the requisite parental consent.

We employ a consent verification process for users who are identified as minors. This process is designed to verify the consent of a parent or legal guardian, ensuring compliance with legal requirements for minor’s use of online services.

    • In no circumstance shall DrWellbeing Inc. or its affiliates bear responsibility for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services. Positive School Transition Readiness Survey

  • All content, materials, and intellectual property provided through the Positive School Transition Readiness Survey on our services are protected by copyright laws. The Positive School Transition Readiness Survey content may not be copied, modified, reproduced, published, or transmitted without prior written consent. Participants may only view or use the Positive School Transition Readiness Survey content under the conditions that: (a) it is not shared with anyone else; (b) it is only used for the purpose for which it was provided to them; and (c) it is used in compliance with the General Terms and Conditions of DrWellbeing Inc..

Modification of Terms

  • We reserve the right to modify or update these terms and conditions at any time without prior notice. By continuing to use our services after such modifications, you agree to be bound by the revised terms [defined as Modified Terms].

Indemnity

  • DrWellbeing Inc. (“the Company”) shall be indemnified and held harmless by the user (“the User”) from and against any claims, damages, liabilities, costs, and expenses arising out of or in connection with the User’s use of DrWellbeing’s services, including but not limited to any violation of these terms and conditions, infringement of intellectual property rights, or breach of confidentiality. The User agrees to indemnify the Company for any losses incurred, including legal fees and expenses, arising from such claims.

Governing Law

  • These terms and conditions shall be governed by and construed in accordance with the laws of Alberta, Canada, without regard to its conflict of law provisions.

Dispute Resolution

  • Any disputes or claims arising out of or relating to these terms and conditions or the use of our services shall be resolved through arbitration or informal methods before resorting to any formal actions.

Assignment, Severability, and No Waiver
